Terms of Service
ABN: 58 673 728 526
1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and HSJ Host Pty Ltd (“we”, “us”, “our”) governing your access to and use of the Cyber Aware online learning platform, website, and related services (the “Platform”).
By registering an account, subscribing, logging in, or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Platform.
2. Who we are
The Platform is operated by HSJ Host Pty Ltd and made available at cyberaware.hsj.host. We refer to this offering as “Cyber Aware” for convenience. That name is a service label only—we do not own or claim any trademark or other proprietary rights in “Cyber Aware”, and use of the name on this site does not imply endorsement by any third party.
Our contact details are set out at the end of these Terms.
3. Eligibility and accounts
You must be able to form a legally binding contract under applicable law to use the Platform. You are responsible for ensuring your registration information is accurate and kept up to date.
- You must keep your login credentials confidential and notify us promptly if you suspect unauthorised access to your account.
- You must not create an account for anyone else without authority, or use a false identity or misleading contact details.
- You are responsible for activity that occurs under your account unless you have notified us of unauthorised use and we have had a reasonable opportunity to act.
- We may offer optional two-factor authentication (2FA). We strongly encourage you to enable 2FA where available.
4. Subscriptions, fees, and billing
Certain features require a paid subscription. Prices, billing intervals, and inclusions are shown at checkout or on our subscribe page and may change from time to time for new purchases.
- Payments are processed by Stripe or another payment provider we nominate. You authorise us and our payment provider to charge your chosen payment method for recurring fees until you cancel in accordance with these Terms.
- Where a free trial is offered, paid access begins when the trial ends unless you cancel before then. Trial eligibility and duration are as displayed at sign-up.
- You may cancel a subscription through your account or billing portal where available, or by contacting us. Cancellation stops future charges; access generally continues until the end of the current paid period unless we state otherwise.
- If a payment fails, we may suspend or downgrade access until the account is brought current.
- Fees are in Australian dollars unless stated otherwise and may include GST where applicable.
Refunds are handled in line with the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer guarantee, right, or remedy you have under the ACL or other applicable law.
Except where required by law, we do not provide refunds for change of mind or partial use of a billing period already commenced.
5. Platform access and acceptable use
We grant you a limited, non-exclusive, non-transferable licence to access and use the Platform for your personal or internal business learning purposes in accordance with these Terms.
You must not:
- Copy, scrape, resell, sublicense, or commercially exploit Platform content except as we expressly permit.
- Circumvent access controls, share paid content with non-subscribers, or use another person’s account.
- Upload malware, attempt unauthorised access, interfere with Platform operation, or overload our systems.
- Harass, threaten, defame, or discriminate against others, or post unlawful, misleading, or infringing content.
- Post spam, advertising, or off-topic material in discussion areas without our consent.
- Misuse certificate verification, impersonate another learner, or falsify completion records.
We may monitor use of the Platform to enforce these Terms, protect users, and comply with law. We may remove content, suspend features, or terminate accounts where we reasonably believe a breach has occurred.
6. Courses, resources, and certificates
Course materials, quizzes, resources, and certificates are provided for educational purposes. Completion of a course and passing required assessments may entitle you to a certificate of completion issued through the Platform.
- Certificates confirm that you completed the relevant course requirements on the Platform at the time stated. They do not constitute professional accreditation unless we expressly state otherwise.
- Our public certificate verification tool allows third parties to confirm a certificate number is valid. Only information necessary for verification may be displayed.
- We may update, replace, or retire courses and resources. We will use reasonable efforts to avoid disrupting in-progress learners, but we do not guarantee perpetual availability of any particular content.
7. Discussion and community
Discussion areas allow registered users to post topics and replies subject to these Terms and any community guidelines we publish.
- You retain ownership of content you post, but grant us a worldwide, royalty-free licence to host, display, reproduce, and moderate that content for operating the Platform.
- You must respect other users. Do not @mention or quote others to harass them. Report concerns using in-platform reporting tools where available.
- We may edit, hide, or remove posts and may suspend discussion access without notice where moderation is required.
8. Intellectual property
Platform software, design, course content, videos, documents, and other materials we provide (excluding user-generated discussion content) are owned by or licensed to us and protected by copyright and other intellectual property laws.
The service name “Cyber Aware” and any third-party names, logos, or marks shown on the Platform belong to their respective owners. Nothing in these Terms grants you rights in those marks.
Except for the limited licence in section 5, no rights are transferred to you. You must not remove copyright or proprietary notices from materials.
9. Privacy
Our Privacy Policy explains how we collect and handle personal information. By using the Platform, you acknowledge that policy.
10. Suspension and termination
You may stop using the Platform at any time and may request account closure by contacting us.
We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, pose a security risk, or where required by law. On termination:
- Your licence to use the Platform ends.
- We may retain records as required by law or for legitimate business purposes (including billing and certificate records).
- Provisions that by their nature should survive (including intellectual property, disclaimers, and liability limits) continue to apply.
11. Disclaimers
The Platform and content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Cyber security education reduces risk but cannot guarantee protection against all threats. You are responsible for applying learning appropriately in your own environment and decisions.
We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
12. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Platform is limited to the greater of (a) the fees you paid us for the subscription giving rise to the claim in the 12 months before the claim, or (b) AUD $100.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, or loss of profit, revenue, data, or goodwill.
Nothing in these Terms limits liability that cannot be limited under the ACL or other applicable law, including liability for fraud or gross negligence where exclusion is prohibited.
13. Indemnity
You indemnify us against losses, claims, and expenses (including reasonable legal costs) arising from your breach of these Terms, misuse of the Platform, or content you post, except to the extent caused by our wrongful act or omission.
14. Changes to these Terms
We may update these Terms from time to time. The current version will be published on this page with an updated “Last updated” date. Material changes will be notified where required by law—for example by email or notice on next login.
Continued use after the effective date of updated Terms constitutes acceptance, to the extent permitted by law.
15. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
If a dispute arises, contact us first at contact@hsj.host and we will attempt to resolve it in good faith before either party commences formal proceedings, except where urgent injunctive relief is required.
16. General
- If any provision is invalid or unenforceable, the remainder continues in effect.
- Our failure to enforce a provision is not a waiver of that provision.
- You must not assign your rights under these Terms without our consent. We may assign our rights to a related body corporate or successor.
- These Terms, together with the Privacy Policy and any plan-specific terms shown at checkout, constitute the entire agreement between you and us regarding the Platform.
